1. Introduction
1.1. Capitalized terms, unless otherwise defined, have the meaning specified within the Definitions section contained in the Terms of Use.
1.2. This webpage represents a legal document that serves as our Terms of Sale and it governs the mutual rights and obligations arising from or in connection with the contract of sale for purchases, in particular a Premium Membership, concluded through the Website between RekrutMe and a Registered User. These Terms of Sale form an integral part of the contract of sale, which can be only concluded in English.
1.3. These Terms of Sale, along with the Terms of Use, Privacy Policy, and other posted guidelines within the Website, constitute the entire and only agreement between you and RekrutMe, and supersede all other agreements, representations, warranties and understandings with respect to our Website and the subject matter contained herein.
1.4. Please read these Terms of Sale carefully. By purchasing a Premium Membership from RekrutMe on the Website, you agree to be bound by these Terms of Sale. If you do not agree to any of the terms and conditions below, do not make any purchases on the Website. You hereby confirm that you have read and understood that you are bound by these Terms of Sale in addition to the previously accepted Terms of Use (as a Registered User) at the time of purchase.
1.5. We may amend our Legal Terms at any time without prior written notice. The latest copies of our Legal Terms will be posted on our Website, and you should review all Legal Terms prior to each purchase using our Website. Any such change or revision shall become effective immediately upon posting and you hereby agree to be bound to any such changes to them.
2. Purchase Prerequisites
2.1. In order to make buy a Premium Membership from the Website, you need to be a Registered User, in the possession of a credit card and in the position to legally make a purchase. You are responsible for keeping confidential your user account information, namely user name and password, for security of your account data and billing information.
2.2. If you are a Registered User, RekrutMe will make available optional premium services against a subscription fee, offering an upgrade from an initial free membership to a paid Premium Membership.
3. Subscription Terms
3.1. RekrutMe makes available three Premium Memberships, a monthly, an annual and a lifetime membership, of which the Registered User may choose to opt into against the payment of a subscription fee. The amount of subscription fee is always clearly stated on the Website prior to the purchase. The Registered User agrees with the conclusion of the contract of sale via electronic means.
3.2. Monthly Premium Membership: The Registered User is hereby made aware of the monthly nature of the Monthly Premium Membership and agrees to an initial and a recurring Monthly Subscription fee in the next billing cycle and accepts responsibility for all recurring charges until the Registered User cancels the subscription. The Registered User understands that even in case the Monthly Premium Membership terminates early (regardless of the reason for termination), the monthly subscription fee represents a one-shot payment, which is entirely non-refundable once made. The Registered User may cancel the Monthly Premium Membership at any time, subject to the terms of our cancellation policy.
3.3. RekrutMe may automatically charge the same monthly subscription fee after expiration of one payment cycle (one month).
3.4 Annual Premium Membership: The Registered User is hereby made aware of the annual nature of the Premium Membership and understands that even in case the Annual Premium Membership terminates early (regardless of the reason for termination), the annual subscription fee represents a one-shot payment, which is entirely non-refundable once made.
3.5. Lifetime Premium Membership: The Registered User is hereby made aware of the nature of the Lifetime Premium Membership and understands that even in case the Lifetime Premium Membership terminates early (regardless of the reason for termination), the initial subscription fee represents a one-shot payment, which is entirely non-refundable once made. The Lifetime Premium Membership is limited to a period of four consecutive years.
3.6. All Premium Memberships are limited for use by one Registered User only and non‑transferable.
3.7. The contract of sale shall be concluded upon the submission of payment details to the payment processor by the Registered User. Access to the Premium Membership content will be made available to the Registered User upon the confirmation of successful payment by the payment processor. You shall keep the billing information on your RekrutMe account up‑to‑date in order to enable the automatic renewal of the subscription.
3.8. In the event that automatic renewal fails (due to missing billing information, change of credit card, loss of credit card), RekrutMe has the right to immediately terminate the Registered User’s Premium Membership and reactivate the free membership on behalf of the Registered User.
3.9. Please note that you are recommended to email info@rekrut.me in the event of a denied credit card payment or other problems in relation to a payment transaction on the Website.
4. Payment
4.1. By completing the billing information, the Registered User agrees to provide RekrutMe with accurate information with regard to location of residency of the Registered User. Based on provided information, RekrutMe collects sales tax (VAT) according to European law, which is payable by the Registered User in relation to such purchase.
4.2. RekrutMe accepts payments by credit cards. Upon the conclusion of the contract of sale, you authorize RekrutMe to charge the account for the amount of the chosen purchase. Payments on RekrutMe can be stated and billed in EUR, USD, or CZK.
5.1. You can terminate your Premium Membership at any time. In such case, your Premium Membership will expire by the end of the calendar month.
5.2. Any purchase made on the Website, in particular the purchase of a Premium Membership, is non-refundable as it consists primarily of digital content and is made available (consumed) immediately after the purchase. You do not have the right to withdraw from the contract.
6. Final Provisions
6.1. The full scope of legal rights and obligations related to the Website (Legal Compliance, Intellectual Property, Revisions and Errate, Limitation of Liability, Governing Law and Dispute Resolution, etc.) included in the Terms of Use applies to the contract of sale, as well, and form an integral part thereof. These Terms of Sale together with the previously accepted Terms of Use constitute the agreement between you and RekrutMe with regard to any of the above‑described purchases you may make on the Website. The contract of sale is stored electronically by RekrutMe and is not accessible to you.
6.2. Alternative dispute resolution is provided by Česká obchodní inspekce (Czech Trade Inspection), with registered seat at Štěpánská 567/15, 120 00 Prague 2, Identification Number: 00020869, https://adr.coi.cz/en. You may also use the European online dispute resolution platform available at http://ec.europa.eu/consumers/odr.
6.3. We provide all information regarding the processing of personal data in a separate document (please see our Privacy Policy).
6.4. You hereby agree to receive commercial correspondence and marketing messages from RekrutMe to the contact details you have provided on the Website.
6.5. These Terms of Sale take effect as of July 1, 2019.
